1. Promotional Fantasy Game of Skill:
The Survival Sports Entertainment Software ("SSES"), Ultimate Survival Pool ("Fantasy Game" or "Game") is a Promotional Fantasy Game of skill where participants use their knowledge and analysis of professional football teams and the NFL season schedule to pick only one team to win each week, for the entire NFL season. NO POINT SPREADS are considered. An NFL team that is chosen in one week may not be chosen again for the remaining weeks of the Game. The Game starts week one of the NFL season and ends the last week of the NFL season, or when there is one remaining participant to the Game. The winner(s) are determined by the objective criteria stated in the "How to play" section of the Official Rules. The actions of the other participants do not affect your ability to survive to the end of the Game. Where more than one participant survives to the end of the NFL season, those participants will divide the prize equally.
2. Your participation in the Game constitutes your acknowledgment and agreement that you have read, understand, agree, and act, with respect to the terms of these Official Rules.
3. Prize. The prize will be paid to the winner(s) as determined by the rules herein. The prize will be paid directly to winning principal participant(s) and only to the winning principal participant(s). The Grand Prize must be accepted as awarded and will be awarded only to the qualifying participant(s) named on the entry form. Identification will be required. All taxes associated with the receipt of any prize are the sole responsibility of the winner(s).
4. How to play: The object of the Game is to use your knowledge and analysis of professional football teams and the NFL season schedule to pick the winner of only one NFL game each week. NO POINT SPREADS & YOU CANNOT PICK THE SAME TEAM TWICE. You may pick any NFL team to win its game that week. ONCE YOU HAVE SELECTED A TEAM, YOU ARE NOT ALLOWED TO PICK THAT TEAM AGAIN FOR THE REMAINDER OF THE NFL SEASON. For Example, if a participant selects The New York Giants to beat The St. Louis Rams in week #1 of the season, that participant may not pick The New York Giants again for the rest of the season but is free to select The St. Louis Rams in any one subsequent week. Obviously, with 30+ teams in the league and only 17 weeks in the NFL regular season (including bye weeks) there are some teams that you will never use.
5. If the team you pick wins in that week, you survive to the next week and remain in the Game. The object here is to SURVIVE as long as possible. The last man or woman to survive takes home the prize! There are no consolation prizes. WINNER(S) TAKES IT ALL!!!!!
6. Duration of the Game: The Game kicks-off on Sunday, (week 1 of the NFL regular-season) and ends after the last game of week 17 of the NFL regular-season, or when there is only one remaining participant in the Game.
7. In the event that multiple final participants all lose in a given week, those participants will move to the next week until the tie is broken. For example, if the final six participants all pick incorrectly in week 13, all six will get to pick again in week 14. If only one participant selects correctly in week 14, that participant wins the Game. If two participants pick correctly in week 14 only those two participants (and not all six who got to pick on week 14) move to the next week.
8. In the event that multiple participants make it through the entire season, those participants will split the prize equally.
9. The deadline for each week's selection: Each participant's weekly selection must be received at least 1 hour prior to the first kickoff time of that week. For instance, on weeks that have, a Sunday game all selections must be received that Sunday 1 hour prior to kickoff, a Saturday game all selections must be received that Saturday 1 hour prior to kickoff, a Thursday game all selections must be received that Thursday 1 hour prior to kickoff. If you do not pick a team in any given week, you are eliminated.
10. SSES Interactive Website: SSES has created a fully interactive website that allows members: to enter their weekly team selections, view the weekly team selections of other participants, track weekly survivors and elimination's, track the number of participants remaining in the Game after each week, print Game stats, and receive email updates with pick confirmations.
11. Technology Problems: Each participant's weekly selection is to be submitted using the SSES interactive website. Only in the event the SSES website is down or experiencing technical difficulties the participant may make their pick via email to: commissioner@UltimateSurvivalPool.com For your security, the email pick must be sent from the email address per your user profile, and the email pick must include: your pick for that week, your first and last name, login name, and pool entry name. If for whatever reason, a weekly pick is recorded both via the interactive website and via email, your most recent pick, considering the deadline period provided in the "Deadline" section above, controls.
12. NFL Scheduling: If for any reason, the NFL amends any portion of its regular season schedule, SSES reserves the right to make necessary changes to the rules of the Game (including, but not limited to, determining prize winner(s) based on the principal of "last man standing”).
13. Prize Notification: Winner(s) will be notified by email or regular mail within 30 days after the official end of the NFL regular season, or within 30 days after there is only one winner left standing. Weekly and overall results are posted on the website at the conclusion of each week. The prize winner(s) grant permission to SSES to use their name and/or likeness for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent.
14. Eligibility: You must be 18 years of age or older to participate. Residents of jurisdictions that prohibit participation in the Game, are not eligible to participate. Based on the “Province / State” input in the “Profile Information” section, eligibility will be determined. Persons legally residing in any other jurisdictions may enter. By entering the Game, applicants agree to abide by all terms of the Official Rules applicable thereto. By entering the Game, entrants agree to provide certain personally identifiable information to SSES which information shall become the property of SSES. Please review the SSES privacy policy to see how SSES treats personally identifiable information. Subject to all local, state and federal laws and regulations. Some restrictions apply. Void wherever prohibited or restricted by law.
15. No Purchase Necessary: A purchase will not increase an entrant’s chance of winning. Entry by mail can be completed by sending all information necessary to participate in the Game each week (Send a type written - weekly pick, valid legal name, valid social security number, valid date of birth, valid address of residence, phone number (with area code) Valid E-mail Address, a photocopy of valid drivers license or government issued identification), and a letter sized self-addressed stamped envelope sent to: Survival Sports Entertainment Software (SSES), 3495 Cambie Street, Suite # 379 Vancouver,British Columbia, Canada V5Z 4R3. The aforementioned information is required as an attempt to avoid a dispute as to the identity of an entrant. The aforementioned information is required each week a pick is made, and subject to the "Deadline" section in these Official Rules. SSES is not responsible for misdirected or lost mail. SSES reserves the right to disqualify any mail-in entry that arrives late, or is received with insufficient, incorrect or illegible information. Limit one (1) mail in entry per person. You cannot mail in an entry on behalf of someone else or the deceased. Only a US or Canadian, individual, citizen with legal residence in the U.S. or Canada is eligible for mail in entry. Your mail in entry in SSES's Game constitutes your acknowledgment and agreement that you have read, understand, agree, and act, with respect to the terms of the Official Rules, and that you have not paid any consideration for the purpose of participating in SSES's Game. All entries become property of SSES and will not be acknowledged or returned. False or deceptive entries or acts, as determined by SSES, will render the entrant ineligible. Void of all services, a mail in entry is not eligible to access/use the SSES interactive website, and is not eligible to view information or statistics provided on the SSES interactive website or any weekly email updates.
16. Promoter and Sponsor of Promotion: Survival Sports Entertainment Software (SSES), 3495 Cambie Street, Suite # 379 Vancouver, British Columbia, Canada V5Z 4R3. Official Rules, and a List of winner(s) are available upon request in a self addressed stamped envelope.
17. Internet / Technology problems: If for any reason the Internet Game software does not function correctly as a result of, but not limited to, a computer virus or bug, tampering, unauthorized intervention, fraud, technology failures or any other causes that are beyond the control of SSES which corrupt or adversely affect the administration, security, fairness, integrity, or proper conduct with respect to the Game, then SSES reserves the right to modify the rules of the Game or suspend the Game. SSES assumes no responsibility for any error, omissions, interruptions, deletion, defect of delay in operation with transmission, communication, line failure, theft, destruction or unauthorized access to the Game website.
18. Tampering: Any attempt by any participant or any individual to deliberately damage the website or undermine the legitimate operation of the Game is a violation of criminal and civil laws. In the event that a tampering attempt is made, SSES reserves the right to seek damages to the fullest extent of the law. Use of automated entry software is prohibited.
19. Disclaimers: SSES is not responsible for any disruptions, injuries, losses of damages caused by events beyond the control of SSES, and is not responsible for any printing or typographical errors in any materials associated with the Game or any subsidiary, affiliated company, or its vendors. SSES is solely responsible for enacting, administering, enforcing the rules, and maintaining the integrity of the Game. SSES, the Game and its website are not sponsored or endorsed by the National Football League or the NFL Players Association.
20. Arbitration, Venue, and Other Matters of General Concern: Any disputes must be mailed to Survival Sports Entertainment Software (SSES), 3495 Cambie Street, Suite # 379 Vancouver, British Columbia, Canada V5Z 4R3. All issues or disputes, including but not limited to, the Game, scoring, or infractions of these rules, will be reviewed and settled by the SSES Advisory Board, whose decisions shall be final. SSES reserves the right to make changes to the Game and/or these rules. Except as otherwise set forth in this paragraph, any controversy or claim arising out of or relating to this contest, whether asserted in contract, tort, statute, or otherwise (including whether or not such controversies or claims are arbitrable) shall be settled by binding arbitration administered by the Canadian Arbitration Association under its Commercial Arbitration Rules then in effect. Liability of SSES, associated partners and affiliates is limited to the amount of the individual participant's entry fee. All hearings and proceedings shall take place in Vancouver, British Columbia using the internal, local laws of the Province of British Columbia (excluding any choice of law provisions that would render the laws of another jurisdiction applicable). The decision of the arbitrator(s) must be based on and consistent with British Columbia substantive internal law. Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Under no circumstances shall any proceeding in a court of law, equity or other hearing of any type take place in forum other that a state court of competent jurisdiction in Vancouver, British Columbia. Participant specifically waives any right of removal of any matter to another Court and agrees that these venue and change of forum provisions are completely binding. If any provision of these rules should ever be held to be invalid or unenforceable, such invalid or unenforceable provision(s) shall be revised by SSES and shall not affect any other provisions of these rules, and such other provisions shall continue in full force and effect. By participating in or registering in the Game, you (I) acknowledge acceptance of these rules and agree to adhere to and be bound by them, (II) release, hold harmless, and waive any rights to recovery against SSES and its sponsors, suppliers, contractors, offices, employees, partners, owners (including but not limited to, corporate and individual), and agents from and against any claims, expenses, damages, and/or liability incurred by you or your representatives in connection with or related to the operation of, or your participation in, the Game, and (III) agree to hold SSES harmless from all typographical, statistical, transaction, and communication errors or omissions, and SSES reserves the right to make corrections to Game books, rules, and other material and information to correct such errors or omissions from time to time without notification. SSES reserves the right to disqualify any participant for cheating, suspected cheating, violation of these official rules or non-adherence to these official rules. All entries become the property of SSES. Prizes awarded in the Game may be subject to legal restrictions. Participants agree that in the event the award of prizes to winner(s) of the Game is challenged by a legal authority, SSES has the sole right to determine whether or not to award such prizes. SSES reserves the right to make any necessary changes to the game and rules as the Game progresses.
21. Disputes/Appeals: Any disputes or appeals will be decided by SSES and its interpretation of the rules. All rulings made by SSES are final and binding.
22. Privacy Policy: Other than a situation where permission is granted, all information provided by participant to SSES will be kept confidential. SSES is NOT in the business of selling or exchanging any information with third parties.
23. Participant Proprietary Information: Any proprietary information provided to participant, including but not limited to, the internet password to access the SSES Game website shall be kept confidential by SSES and the participant.
